Wedding Photography booking terms between The Photographer – Adam Prescott, of Adam Prescott Photography Glenacre, The Street, Belstead, Suffolk and The Client

 

To provide photography services as laid out in The Agreement for their wedding

 

Adam Prescott Wedding Photography is a trading name of Adam Prescott Photography Ltd, registered within the UK as a Limited Company - 11745176.

 

Payment and Booking Fee

 

A completed booking form and a Booking Fee (£250) is payable to secure The Photographers services for The Clients date. The Booking Fee will be deducted from your total balance. The remaining balance will then be payable 60 days before the wedding. In the event that The Client fails to pay the remaining balance within seven (7) days of the wedding date, The Photographer may, at their discretion, treat this agreement as if terminated by The Client. Upon payment of the Booking Fee, The Photographer will reserve the event date on behalf of The Client(s) and reject all other requests for event coverage on that date. Thus, if for any reason the wedding is cancelled or postponed, all monies paid are non-refundable or non-transferable to a new date. To reserve a new date a new Booking Fee will be required at the current rate.

 

Cancellation

The Client may cancel this contract at any time after it has been signed by sending written notice (via email or post) to The Photographer. If the written notification is received more than 120 days before the date the wedding is due to take place then The Photographer will reimburse The Client any monies paid, except for the Booking Fee.

 

If the written notice of cancellation is received within 120 days of the due wedding date then the amount of the fee that The Photographer shall be entitled to is calculated in accordance with the table below (detailing the amount The Photographer is entitled to)

 

0-30 days = 100%, 31-60 days = 75%, 61-90 days = 50%, 90-120 days = 25%, 121+ days = 0%

 

Delivery

While every reasonable effort will be made to produce and deliver the agreed photographs of the event, The Photographer’s entire liability to The Client for any claim arising from The Photographer’s performance or agents and servants (including photographers, processing laboratories and postal and delivery agents) is limited to a refund to The Client of the amount paid for services. The primary photographer for the wedding will be Adam Prescott. If The Photographer is involved in an event rendering him unconscious, liability is limited to a full refund of monies paid. In the unlikely event of photographic equipment failure, the limit of liability for a partial loss of originals shall be a prorated amount of the photographs lost based on the percentage of total number of originals. In the unlikely event of personal illness, Acts of God, or other circumstances beyond the control of The Photographer, a substitute photographer of similar qualifications may be sent to fulfil the obligations of The Photographer herein contracted. If a substitute photographer is provided, The Client has the right to refuse to accept the substitute photographer and may instead terminate this agreement and receive a full refund of all monies paid.

Creative Licence

The Photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. Judgement on photographic style and the number of photographs taken and delivered shall be deemed correct.  The numbers of images provided on the quote are meant as a guideline and failure to provide the indicated number of images shall not be a breach of contract.

 

On its own behalf, and behalf of the subject, Client acknowledges that it is familiar with the Photographer's portfolio and is requesting services with the knowledge of the Photographer's style, that Photographer's work is constantly evolving, that Photographer's services are of unique and artistic nature, that the photos/videos may be different from photographs/videos taken by the Photographer in the past, and that in creating the photos/video, the Photographer shall use its artistic judgement to create images consistent with its personal vision of the event, which vision may be different than the Client's and/or subject's vision of the event. Accordingly, the Client acknowledges that the photos/videos shall not be subject to rejection on the basis of taste or aesthetic criteria. The final post-production and editing styles, effects, and overall look of the images/videos are left to the discretion of the Photographer.

 

The photographer will endeavour to take all the photographs agreed. However, because a wedding is an uncontrolled event, the photographer cannot guarantee delivery of any specifically requested image(s), especially if timings or events are altered without our knowledge. Due to changes of the weather and the availability and willingness of subjects The Photographer will do their best to honour requested photographs but cannot undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

 

During a wedding The Photographer will automatically re-take any photograph where they have seen that someone has blinked, but it is impossible to guarantee to see them all. The more people in the photograph the more difficult it is to see everyone.

The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. Owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres, it is sometimes impossible to record on film/digital media the exact colour of materials as seen by the human eye. 

 

Any additional editing and/or retouching will be subject to an hourly rate of £40 per hour. Retouching includes but is not limited to additional skin softening/smoothing, correction of hair/makeup/clothing, swapping a face from one image to another, environmental effects, reflections in glasses, teeth whitening, brightening of eyes, and bodily enhancements.

 

The client does not have a right to view or obtain all the images captured on the day, The Photographer will use their judgement as to which images are provide in the final gallery, this will be consistent with The Photographers other galleries and industry normals.  All RAW files will not be provided under any circumstances.

 

House Rules

The guidelines of the ceremony official and the reception site management limit The Photographer. The Client agrees to accept the technical results of their imposition on The Photographer. Negotiation with the officials for moderation of guidelines is The Client’s responsibility; The Photographer will offer technical recommendations only.

 

Exclusivity

The Photographer shall be the sole professional (still) photographer(s) at the venues specified.  If a guest or other party interferes with The Photographer in the course of their work during the wedding day (getting in the way, using the photographer set shots to further their own portfolio, deliberately hindering The Photographers shots) the service will cease until the issue can be resolved.

 

Files

 

Once a set of high resolution digital files have been delivered, the responsibility to preserve the images passes to The Client. The Photographer will keep a copy for no more than 5 years of the final edited images and the associated RAW files.

 

Copyright

The 1988 Copyright Act assigns the copyright to the photographer. It is contrary to the Act and strictly illegal to copy or allow to be copied, any photographs covered by this contract. The Photographer grants The Client permission to make copies of the images under the conditions that the images taken by the Photographer are for personal use by The Client and their friends and relatives. The Photographer will provide The Client with a print licence as proof of this permission. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from The Photographer. 

 

Consent for Photography/Filming

 

We/I consent to Adam Prescott Photography using photographs and/or video recordings including images of us/me both internally and externally to promote Adam Prescott Photography. These images could be used in print and digital media formats including print publications, websites, e-marketing, advertising, film and social media purposes.

 

We/I understand that images on websites can be viewed throughout the world and not just in the United Kingdom, and that some overseas countries may not provide the same level of protection to the rights of individuals as EU/UK legislation provides.

 

We/I understand that some images or recordings may be kept permanently once they are published and be kept as an archive of photographic works completed.

 

We/I have read and understand the conditions and consent to our/my images being used as described. This is not contractual and you are free not to sign this consent.

 

Adam Prescott Photography is committed to processing information in accordance with the General Data Protection Regulation (GDPR). The personal data collected on this form will be held securely and will only be used for administrative purposes.

 

In general terms only images of the couple will be used, but is understood that some group shots may also be used as a legitimate interest to promote Adam Prescott Photography.

 

Images of any person clearly under the age of 13 will not be used in print or digital media format including print publications, websites, e-marketing, advertising, film or social media. Should any member of your wedding/event not wish for their image to be used or taken they should advise the photographer on the day.

 

Your rights

 

You have the right to request to see a copy of the information we hold about you and to request corrections or deletions of the information that is no longer required. You can ask the Adam Prescott Photography to stop using your images at any time, in which case it will not be used in future publications but may continue to appear in publications already in circulation.

 

You have the right to lodge a complaint against Adam Prescott Photography regarding data protection issues with the Information Commissioner’s Office (https://ico.org.uk/concerns/).

In the event of any dispute regarding this contract, both parties agree to attempt to obtain a conciliation before taking any other action.

By agreeing you are entering into a legally binding contract and you are urged to read the terms and conditions carefully.
